Claims Avoidance
Even successful projects can have claims. Claims are a natural outgrowth of a complex and highly competitive process during which the unexpected often happens. Careful organization and coordination of numerous parties are required and it may then be outside parties that control many of the circumstances and events that generate claims. The possibility that a claim might develop should not be ignored. The responsible owner, contractor, trade contractor or designer must recognize the need and anticipate the circumstances that foster claims and develop effective and affirmative strategies for dealing with them. Managing techniques to limit risk and avoid disputes is the subject of Chapter 13 of Common Sense Construction Law.
