Stephen J. KelleherAssociate
STEPHEN J. KELLEHER is an associate in the Washington, D.C. office of Smith, Currie & Hancock LLP. Stephen’s practice specializes in the area of government contracts and construction law.
Stephen’s experience includes advising a client regarding a large bid protest, counseling contractors on the viability of subcontract language to be used on federal projects, and pursuing numerous requests for equitable adjustments to a contract for adverse weather delays, changes and differing site conditions a U.S. Army Corps of Engineers project. He has also assisted in the development and implementation of a company ethics code and program in order to comply with the Federal Acquisition Regulation. He has represented a client in connection with a Civil False Claims Act case and counseled clients regarding the 2009 Fraud Enforcement and Recovery Act amendments to the False Claims Act. Stephen’s experience also extends to advising a federal contractor on the interaction of collective bargaining agreements and the Service Contract Act. His practice also involves counseling clients on changes in the law that allow past performance evaluations to serve as the basis for a Contract Disputes Act claim, the de novo review rule of contracting officer’s decisions, and the complexities of the Miller Act, including forum selection, arbitration of claims, and the Act’s waiver provisions.
Stephen is contributing to the forthcoming second edition of Smith, Currie & Hancock's Federal Government Construction Contracts.
Stephen attended the University of Virginia School of Law and received his J.D. degree in 2008. He graduated from the University of Notre Dame in 2001 with a Bachelor of Arts in History and received a Masters in Education from University of Notre Dame in 2003. Prior to joining Smith, Currie & Hancock, Stephen taught for four years in Memphis, Tennessee and completed a fellowship at the Cobb County office of Legal Aid of Atlanta.
